How to successfully get planning permission?

To improve your chances of securing planning permission, research local requirements, consult your planning authority and submit a complete well-documented application. Understanding local policies and engaging with neighbours can also make a meaningful difference. Pre-application advice can improve the chances of getting planning permission but doesn’t guarantee approval, it provides opportunity to receive feedback from the local council ahead of submitting a full planning application. A question we get asked all the time and the simple answer is: no, you do not legally need an architect to apply for planning permission. Is it a legal requirement to have building regulations?

If you are carrying out building work personally, it is very important that you understand how the building regulatory system and material applies to your situation as you are responsible for making sure that the work complies with the building regulations.

If you are employing a builder, the responsibility will usually be theirs - but you should confirm this at the very beginning and ensure that they are competent person. You should also bear in mind that if you are the owner of the building, it is ultimately you who may be served with an enforcement notice if the work does not comply with the regulations, find more information here.

What happens if a builder does not comply with building regulations?

Where applicable, the client, designer and contractor all have a clear legal duty under section 2A of The Building Regulations 2010 to comply with the relevant requirements of the building regulations as of the Building Regulations etc. (Amendment) (England) Regulations 2023.

It sets out stricter responsibilities for those involved in the design, construction, and management of high-risk buildings and strengthens oversight of building materials and resident safety.
